General conditions of the temporary rental (minimum 32 nights maximum 9 months)
1. PURPOSE: The property is not rented with the purpose of satisfying the permanent housing needs of the lessee, being the usual address provided by the lessee, exempting the lessor from any liability arising from the accuracy of the information provided by the lessee. It is not rented for any commercial or professional purpose or for any type of activity that could be illicit, annoying or harmful, both for the property and for the safety of the population or neighbors. The present contract is granted in the interest of the contracting parties, being therefore non-transferable in whole or in part to any other person. The lessee may not assign the lease or sublet the property without the express written consent of the lessor. Should the Lessee fail to comply with this condition, the Lessor may terminate the contract.
2. DURATION: This temporary rental contract is granted for the agreed period, with the keys of the property being handed over by both parties between 9.00 a.m. and 3.00 p.m.. This contract will be automatically terminated without prior notice.
3. PRICE: The rental price is paid upon signing this contract, which serves as a receipt of payment. This amount includes general expenses, taxes, services, weekly cleaning, as well as utilities (water and electricity) up to a limit of 120.00 euros per month. The tenant agrees to pay the deposit and any extra services before check-in. For stays of less than 60 nights, the full payment for the stay must be made before check-in.
Optional services such as parking space and linen change are not included in the rental price and must be paid upon signing this contract.
4. DEPOSIT: The lessee and the persons living, visiting or staying in the apartment are obliged to make a convenient and reasonable use of the means of comfort made available by the lessor.
In addition, the lessee shall deliver the sum of ONE THOUSAND TWO HUNDRED EUROS (1.200€) as a deposit to respond to any damage or harm that may be caused both to the property and its contents. This amount will be returned to the tenant within 10 days after the end of the contract and signing of the check-out, and only if the property has been returned in perfect condition, as it was delivered, and once the electricity and water consumption has been regularized.
5. CONDITION OF THE PROPERTY: The Lessor undertakes to deliver the apartment fully equipped and available for immediate occupancy, and agrees to deliver it with the list of services, furniture and fixtures listed in Annex I.
At the expiration of the agreed term, the lessee shall leave the apartment subject of this contract, free, empty and free of debris, except for the furniture and inventory.
6. HOUSING RULES: Under no circumstances may flammable, explosive or corrosive materials be kept in the property. Animals of any kind may not be kept in the apartment, nor may any kind of industry or immoral or unusual activities be carried out in the apartment that may cause a nuisance to the other residents of the property. If justified complaints are made by the neighbors, it will be considered cause for immediate termination of the rental with loss of the amounts paid on account and deposit as compensation.
The tenant undertakes to follow and respect the rules of the building, swimming pool and apartment contained in the contract.
7. THE LESSOR UNDERTAKES TO PROVIDE THE LESSEE:
a. A dossier with information of interest (including WIFI and its password), as well as emergency telephone numbers that the guest must know.
b. Face-to-face or telephone assistance 5 working days a week during daylight hours, offering an emergency telephone service that is operational 24 hours a day.An emergency is understood to be any problem that hinders the habitability of the apartment or the safety of its occupants.
c. Prior to the tenant's entry, he/she will receive by email or WhatsApp a code and/or link from ELEA OPEN that will give him/her access to the virtual keys to access the building and apartment.
8. CANCELLATION AND MODIFICATION POLICY: Cancellations made up to 30 days prior to the check-in date will be fully refunded. Later cancellations will have to be paid 100%. Modification of check-in or check-out date is subject to availability. Modifications and/or cancellations will be charged for cleaning services and extras that have been contracted. Extensions of stay are subject to availability.
9. APPLICABLE LEGISLATION: This Contract shall be governed by the clauses of the same and, failing that, by the provisions for leases of the type “use other than as a dwelling” in the current Urban Leases Law (Law 29/1994, of November 24), and, supplementarily, by the provisions of the Spanish Civil Code.
10. JURISDICTION: The parties submit to the jurisdiction and competence of the courts and tribunals of Barcelona, expressly waiving their own jurisdiction, if different.
